Federal workplace harassment and violence prevention program template (English and French)

What’s in the program

1. Roles and responsibilities

Who the program covers, from employees, students and interns to former employees and third parties, the applicable partner you do the joint steps with and what happens when you can’t agree, and the duties of senior management, supervisors, employees, the designated recipient, committees and investigators.

2. Work place assessment

The joint assessment of the risk factors the Regulations list: culture and conditions, outside circumstances, reports and records, physical design and the measures already in place, with the typical risk factors in federally regulated work, preventive measures and an implementation plan, and when the assessment is reviewed.

3. Harassment and violence prevention policy

Your policy, ready to adopt jointly and sign, with all eleven elements subsection 10(2) of the Regulations requires, how it was developed, and how you make it available to every employee.

4. Emergency procedures

What to do when an occurrence puts someone in immediate danger or there is a threat of one, the person in charge, a quick-reference card, and the review after every use.

5. Training

A starter syllabus covering what section 12 of the Regulations requires, added modules for people with a role in the program, who is trained and when, training for the employer and the designated recipient, and training records.

6. Support for affected persons

The support you offer, information on support services in each employee’s area, and the other recourse open to them.

7. Resolution process

Every step from notice of an occurrence to completion, with a timeline from day 0 and every time limit the Regulations set: the initial review, contacting the parties within 7 days, negotiated resolution, conciliation, monthly status updates, and what changes when the employer is a party.

8. Investigations

When an investigation is carried out, the three ways to choose an investigator, qualifications and the no-conflict statement, running the investigation, the report, and deciding on and carrying out the recommendations.

9. Records and confidentiality

Protecting privacy at every step, what committees and the representative may and may not receive, the records the Regulations require, how long to keep them and how to store them.

10. Reporting to the Labour Program

The annual report on the previous calendar year’s occurrences, collecting the numbers through the year, the report within 24 hours of a death, and what to have ready when the Labour Program visits.

11. Reviewing the program

One calendar of every review the Regulations require, the three-year review, reviews after a change, and recording every review and joint decision.

Written to the Regulations, step by step

Every federally regulated employer needs the measures the Work Place Harassment and Violence Prevention Regulations prescribe: a work place assessment, a policy, emergency procedures, training, support for affected employees, a resolution process with set time limits, records and an annual report. This program gives each one its own section, in the order you will use them.

Most steps are done jointly with your applicable partner: the policy committee or, if you have none, the work place committee or the health and safety representative. The program says which steps those are and how to record each joint decision.

Appendix A maps all 74 requirements to the section that meets them, so you can show a Labour Program official where each one is. A template can’t make you compliant on its own, and we don’t claim it does. What it gives you is a complete program to adopt, tailor and follow.

In English and in French

Questions

Who is federally regulated?

Part II of the Canada Labour Code covers employment in federal works, undertakings and businesses: for example, trucking, bus and courier companies whose work crosses a provincial or national border, airlines, railways, shipping, banks, telecommunications and broadcasting, and federal Crown corporations. Most other employers are provincially regulated and follow their own province’s law. Whether a business is federal depends on how it actually operates, so if you are not sure, confirm it with the Labour Program or a lawyer before you rely on a federal template.

Do I get both the English and the French program?

Yes. Every purchase includes both editions as separate Word files, and both are on your confirmation page, in your email and in Find my downloads. Lifetime updates cover both.

Is this my health and safety program?

No. Harassment and violence prevention has its own regulations under Part II of the Canada Labour Code, and this program covers them. Your hazard prevention program under the Canada Occupational Health and Safety Regulations is a separate document: for carriers, that is our Federal Road Transport Health and Safety Manual, which points to this program for harassment and violence. The Federal Carrier Bundle has both, with the NSC Safety and Maintenance Program.

What format is it in?

Two editable Microsoft Word (.docx) files on US Letter pages, one in English and one in French. They work best in desktop Word for Windows or Mac. They also open in Google Docs and Word on the web, where you use Find and replace to put your company name in.

Is this legal advice? Will it make us compliant?

It is a template, not legal advice: written to the Regulations and the Code with every requirement cited, for you to tailor to your work places and adopt jointly with your applicable partner.
